We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth). The APPs and this Privacy Policy govern the way in which we collect, use, disclose, store, secure, and dispose of your Personal Information.

  1. Interpretation
    • In this Policy document:
      • Act means the Privacy Act 1988 (Cth).
      • APPs means Australian Privacy Principles contained in the Privacy Act 1988 (Cth).
      • Product means Clerkible, and any content created via Clerkible.
      • Provider (referred to as either "the Provider", "We", "Us" or "Our" in this Agreement) means Kono Designs.
      • Service refers to the Website and the Product and includes all software, data, text, images, and other content made available through the Website and the Product, but does not include Third-party Services.
      • You/User means you or any end user of the product and Your has the corresponding meaning.
      • Third Party Payment provider means Stripe or any other third payment provider used by the Provider.
      • Information means any information collected by the Provider, including the information referred to in paragraph 2 of this Privacy Policy.
      • Resend means the email automation service known as Resend accessible at resend.com.
      • Sensitive Information has the meaning set out in the Act.
    • The applicable law is the law of South Australia.
  2. Data collection and storage
    • The Provider will record the following information in accordance with the APPs and regarding your use of the product:
      • a) Information provided to the Service when you sign up as a User, including email address, name, and display image, and other personal information you may provide ("Personal Information").
      • b) A record of Your usage
      • c)the date and time of Your visit/s to the site/Service
      • d)the pages accessed and documents downloaded
      • e)the type of browser used.
      • f) A copy of any payment receipt received from a Third Party Payment provider.
      • g) The data the User has input into the Service.
      • h) The Service's output.
      • i) Information received from third parties.
    • No attempt will be made to identify Users or their browsing activities beyond the above information except, in the event of an investigation, where a law enforcement agency may exercise a warrant to inspect our service provider's logs, or as otherwise required by law.
    • Sensitive Information will only be used:
      • a) For the primary purpose for which it was obtained;
      • b) For a secondary purpose that is directly related to the primary purpose;
      • c) With your consent; or where required or authorised by law.
    • Other Information including Personal Information will only be disclosed if you consent to the disclosure or as may be authorised or required by law.
    • The Information will be stored in a manner that protects it from mis-use, loss and unauthorised access, modification or disclosure.
    • The Information will be stored within the Third Party provider Firebase.
    • The Information will be deleted upon the User deleting their account.
  3. Consent to DISCLOSURE, use, and storage
    • You consent to the storage of the Information in accordance with this Privacy Policy as amended from time to time.
    • You consent to and agree the use of the Information by the Provider to improve and develop the Product, including by waiving any intellectual property rights you may have over the Information to the extent that is necessary for that use.
    • You consent to the use of the Information by the Provider.
    • You consent to the Information, including Personal Information being disclosed as may be authorised or required by law.
    • You consent to the Provider disclosing your Personal Information, limited to your email address and username, to SendGrid, or such other third-party email automation service as the Provider may use from time to time, for certain communications with You. This Personal Information will not be sold or disclosed to SendGrid, or such other third-party email automation service as the Provider may use from time to time, for any purpose other than to facilitate communications with You. SendGrid have their own Privacy Policy which We encourage you to view on their website.
  4. Your access to your personal information
    • You may access the Personal Information that the Provider holds about you and you may update or correct it. You will not be permitted to access all of the Information that we hold about You.
    • Requests for access to Personal Information must be in writing to the Provider and we may require identification from you before releasing the requested information.
  5. Acceptance and acknowledgement of risk

    You agree and acknowledge that You are aware that there are inherent risks associated with transmission of information via the Internet. You should make your own assessment of the potential risks to the security of your information when making a decision as to whether or not you should utilise this site and the Product.

  6. Links to other websites or products

    This site or the Product contains links to other websites. You should be aware that this Privacy Policy does not apply to those websites.

  7. Amendments and update to Privacy Policy

    This Privacy Policy may be amended from time to time by the Provider. The up to date Privacy Policy will be available at www.clerkible.com.au.

  8. International law

    This Privacy Policy complies with the laws of South Australia. To the extent that the laws of other jurisdiction may apply, the Provider will make it best endeavours to comply with the relevant laws, but gives not warranty that it will.
